Without planning permission the creation of a new vehicular access onto the A37 highway including the removal of a section of hedgerow and the installation of a five bar gate, and the creation of an area of hard surfacing.  The requirements of the notice are: (i) Remove the 5 bar gate and posts; (ii) Take up the hard surfaced area and restore the land to its previous condition; (iii) Remove the resultant materials from the land; and, (iv) Permanently stop up the access.  The period for compliance with the requirements is 3 months.  The appeal is proceeding on the grounds set out in section 174(2) (a), (b), (c) and (f) of the Act
