without planning permission the unauthorised change of use from a retail shop (Class A1) to a scooter repair and sales business (sui generis).  The requirements of the notice are: a) Cease the use of the ground floor shop unit as a sui generis scooter sales and repair business.  The period for compliance with the requirements is 3 months.  The appeal is proceeding on the ground set out in section 174(2)(a) of the Town and Country Planning Act 1990 as amended. The application for planning permission deemed to have been made under section 177(5) of the Act as amended also falls to be considered
