The appellant failed to secure adequate mitigation measures to avoid adverse effects on the integrity of the Ramsar Site, as neither the proposed Package Treatment Plant option (lacking statutory undertaker adoption) nor the credits-only option (lacking prior securing of credits through appropriate mechanism) satisfied the requirements of Policy EQ4 and the Habitat Regulations.
