What decided it
The conflicting claims regarding tree root severance, absence of topographical data on fill requirements, and inability to ascertain the effects of compaction and weight on the root protection areas meant the scheme could have dire consequences for the long-term health of the protected trees, and this harm was not outweighed by the appellant's personal circumstances.
