What decided it
The existence of the Extant Scheme (25 apartments) as a realistic fallback position, combined with Wilderton House's state of disrepair and poor ownership situation, justified allowing the appeal despite the less than substantial harm to the conservation area.
The less than substantial harm to the conservation area, which attracted considerable weight, was outweighed by the material consideration that dismissal would likely result in the more harmful Extant Scheme being built instead, justifying a decision not in accordance with the development plan.
