Main issues, as the Inspector framed them

  • Appeal A: whether the development would be permitted development with particular regard to the extent of works likely to be necessary to create the dwelling, the use of the site and building, and the extent of curtilage proposed
  • Appeals B and C: the effect the developments would have on the character and appearance of the area with particular regard to the Chelmer North Green Wedge, the special interest of the adjoining grade II listed Springfield Hall, and any protected species on the site

What decided it

The dilapidated condition of the buildings and lack of convincing evidence that works could be limited to conversion, combined with harm to the Green Wedge and listed building setting, with unresolved protected species concerns, meant the developments could not be justified.

The limited public benefits of creating one or two new homes and reversing dilapidation were outweighed by the less-than-substantial harm to the significance of the listed building and its setting, the harmful effects on the character and appearance of the Green Wedge, and unresolved biodiversity concerns.
