What decided it

A suitable compromise solution could be achieved through a condition requiring submission of a scheme that combines a reduced patio size, a privacy screen, and planting, which would eliminate the overlooking harm while retaining most of the patio as built.

The harm caused by overlooking into the neighbouring property was outweighed by the ability to achieve a compromise solution that would eliminate that harm while allowing retention of most of the patio, rather than requiring complete demolition.
