What decided it
The presence of a protected bat roost within the existing building with no mitigation proposed or clearly capable of being incorporated into the development, contrary to Policy CS19 and Circular 06/2005.
The conflict with locational policies would be outweighed by material considerations (previously developed land, visual screening, bus access, neighbour benefit), but this balance was overridden by the unresolved protected species issue which was fatal to the appeal.
