What decided it

The appeal site had not been operating as a retail premises for at least 5 years and was making no contribution to retail vitality, so the proposed A5 use would not reduce A1/A2 use to an unacceptably low level and would instead provide positive economic and vibrancy benefits.

The technical breach of Policy LP28's 50% threshold was outweighed by the particular circumstances: the unit's long vacancy, the positive contribution to local employment and centre vitality, and the addition of variety to takeaway provision, subject to conditions protecting residential amenity.
