Although the Inspector found that the heritage significance of the listed building and the different circumstances from the Whitbourne appeal (Bromyard being a larger market town with adequate alternative facilities) would have outweighed the breach of Policy SC1, the duties under the Habitats Regulations were determinative and required the appeal to be dismissed.
