What decided it

The fallback position of the approved scheme, which would have allowed 3 rooflights in a lower position and slightly larger size, meant the perceived overlooking from the current arrangement was not materially different and therefore not material harm.

The perceived overlooking concerns of the neighbouring occupiers were balanced against the fallback position of the approved development, which would have created a similar perception of overlooking, resulting in the appeal being allowed subject to conditions protecting privacy.
