The balance between serious harm to the character and appearance of the SDNP and the appellant's unmet gypsy and traveller need, lack of alternative sites, and personal/family circumstances, which justified a temporary rather than permanent permission.
The serious harm to the character and appearance of the SDNP was found to outweigh the unmet need, absence of alternatives and personal circumstances to the extent that a permanent permission was not justified, but on balance a temporary, personal permission was proportionate and necessary.
