Main issues, as the Inspector framed them

  • Whether the proposed development would preserve or enhance the character of appearance of the St Mary's Conservation Area (CA) and the setting of the Grade II listed building known as the former Ladywell Baths
  • The effect of the proposed development on the living conditions of the occupiers of No 29 Ladywell Road, with particular reference to outlook
  • The effect of the proposed development on highway safety with particular regard to parking conditions in the vicinity

What decided it

The less than substantial but considerable harm to the significance of the St Mary's Conservation Area, to which great weight must be given under paragraph 199 of the Framework, outweighed the public benefit of providing a two-bedroom dwelling in a sustainable location.

The significant public benefit of delivering a two-bedroom dwelling in a sustainable location with excellent public transport connectivity was outweighed by the less than substantial but considerable harm to the significance of the St Mary's Conservation Area, to which great weight must be given under the Framework.
