What decided it
The proposed digital advertisements would cause harm to the visual amenity of the area by introducing large, permanently illuminated displays that would be considerably more prominent than the existing non-illuminated hoardings and would appear unsympathetic to the surrounding streetscape.
The benefits claimed by the appellant (reduction in waste, fewer maintenance visits, emergency messaging, and economic benefits) were outweighed by the harm to visual amenity, as the powers to control advertisements under the Regulations may only be exercised in the interests of amenity and public safety.
