What decided it
The brightness restriction in Condition 8 is necessary to prevent the frequently-changing illuminated display from unduly distracting and confusing motorists on the well-trafficked Grove Lane, thereby protecting highway safety.
The balance struck was between the appellant's desire to operate the advertisement at higher brightness levels and the Council's need to protect highway safety through illumination controls; the balance tipped in favour of the safety restriction.
