What decided it
The siting of the mast and cabinets would unduly compromise the safety and mobility of pedestrians and cyclists by materially reducing the available width of the shared path, and the appellant failed to provide sufficient evidence that alternative sites were unavailable or more intrusive.
The public benefit from high quality communications infrastructure and network expansion, whilst important, was not sufficient to outweigh the harm caused to pedestrian and cyclist safety and mobility, and the lack of information on alternative sites meant the harm could not be justified by the need to site the installation in the proposed location.
