What decided it

The property was let as a C3 single dwellinghouse from August 2015 to February 2017 under a tenancy agreement explicitly prohibiting subletting and HMO use, which broke the continuity of lawful C4 HMO use and meant the use could not subsequently become lawful within the 10-year enforcement period.
