What decided it

The raised position of the rear-facing window at 471 Brighton Road and the set-back of the proposed extension from the boundary meant that the change in outlook and loss of light would not be harmful, allowing the appeal despite the breach of the SPD 45-degree line guidance.

The benefits of the extension to the appellant's property outweighed the minor and acceptable impacts on the neighbouring property's light and outlook, assessed against the site-specific circumstances rather than rigid application of the SPD guidelines.
