Main issues, as the Inspector framed them
- The first main issue is whether the Red House can be considered an existing community facility.
- The second is if the Red House is considered an existing community facility, the effect of its loss on the quality of life, health and well-being of residents and visitors.
- The third is whether there would be an adverse effect on the integrity of the River Dee and Bala Lake Special Area of Conservation (SAC) and whether there would be an adverse effect on any of the notified interest features of the River Dee Site of Special Scientific Interest (SSSI).
What decided it
The financial and marketing evidence demonstrated the community facility was no longer viable and had no interest from other operators, while alternative community facilities existed locally, meaning the loss would not cause unacceptable harm and the proposal accorded with the development plan.
No harm to the development plan or material considerations was identified against the scheme, so the appeal was allowed without a tilted or weighted balance being required.
