Main issues, as the Inspector framed them
- Whether the Council's decision to refuse to issue a lawful development certificate was well-founded, turning on whether the workshop/log cabin building would benefit from permitted development under Article 3(1) and Class E, Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) (England) Order 2015, specifically whether it would be required for a purpose incidental to the enjoyment of the dwellinghouse as such
What decided it
The proposed use of the building for a commercial dog grooming service with external customers is not incidental to the enjoyment of the dwellinghouse as such, and therefore does not qualify as permitted development under Class E of the GPDO.
