What decided it
The failure to properly secure mitigation for the Special Protection Area through a signed unilateral undertaking meant the proposal could not be assessed as having adequately mitigated its significant effect on the integrity of the designated site, triggering the exception in paragraph 11(d)(i) of the Framework.
Although the Council cannot demonstrate five-year housing land supply, the application of policies in the Framework protecting habitats and biodiversity (the SPA being a protected area) provides a clear reason for refusing the development, and the proposal does not benefit from the presumption in favour of sustainable development in paragraph 11 of the Framework.
