Main issues, as the Inspector framed them
- The effect of the proposed development on the significance of the Grade II listed building Green Windows and its setting
- The effect on biodiversity
- The effect on the character and appearance of the area
- Whether the proposed development can provide safe access to the highway
What decided it
The less than substantial harm to the significance of the Grade II listed building Green Windows, when weighed against the public benefits of the development, was outweighed by the great weight required to be given to conservation of the heritage asset under Framework policy.
The housing land supply shortfall engaged the tilted balance under paragraph 11(d) of the Framework, but the less than substantial harm to the listed building and the unclear biodiversity effect meant that heritage asset policies provided a clear reason for refusal, and the appeal failed.
