Main issues, as the Inspector framed them
- the effect of the proposed development with regard to the character and appearance of the appeal site and surrounding West Cliff and Poole Hill Conservation Area (the CA), including the Unitarian Church (the church), which is a Grade II Listed Building
- the effect of the proposed development with regard to a suitable mix of housing with regard to development plan policies
- the effect of the proposed development with regard to the living conditions of existing and future occupiers
- the effect of the proposed development with regard to the drainage of the site
What decided it
The less than substantial harm to the setting of the listed church and the character and appearance of the Conservation Area, combined with harm to the living conditions of future occupiers, was not outweighed by the public benefits of the scheme.
The benefits of market and affordable housing delivery, highway improvements, holiday accommodation and general economic/social benefits did not outweigh the significant harm identified to the heritage assets and to the living conditions of future occupiers, so the appeal was dismissed.
