The Council's delay in determination, whilst frustrating, did not constitute unreasonable behaviour resulting in unnecessary or wasted expense in the appeal process, as the applicant was forewarned and kept informed, and an appeal would have been necessary regardless given the Council's stated intention to recommend refusal.
