Main issues, as the Inspector framed them
- Whether the principle of a permanent car park is acceptable in this location having regard to Policy 22 of the Lake District National Park Local Plan 2020-2035 which relates to vehicle parking to improve sustainable transport
- The effect on the character and appearance of the Outstanding Universal Value of the English Lake District World Heritage Site with particular reference to its effect on the landscape and visual quality of the area and its extraordinary beauty and harmony
- Whether or not the development results in safe highways conditions for pedestrians and other highway users as a consequence of the connectivity from the site to Pooley Bridge and the steamer pier
What decided it
Appeal A succeeded because the car park as constructed deviated substantially from the approved plans so that condition 2 was not engaged, whereas Appeal B failed because the harm to the National Park landscape, the World Heritage Site and highway safety outweighed the public benefits of the car park.
the public benefits of the car park (farm diversification income, footfall to local businesses, recreational access) did not outweigh the great weight given to harm to the National Park and World Heritage Site together with conflict with sustainable transport and highway safety policy
