Main issues, as the Inspector framed them
- Whether the proposed dwelling would provide satisfactory living conditions for the future occupants, having regard to privacy
- The effect of the proposal on the character and appearance of the area
- Whether the proposal would make satisfactory provision for parking
What decided it
The proposal would not provide satisfactory living conditions for future occupants due to material overlooking from elevated first-floor windows of rear properties combined with insufficient separation and a small rear garden, which harm significantly and demonstrably outweighs the limited housing and economic benefits.
The limited social, economic and environmental benefits of the small windfall development were significantly and demonstrably outweighed by the harm to future occupants' living conditions in respect of privacy, such that the presumption in favour of sustainable development did not apply
