Main issues, as the Inspector framed them

• whether the proposal would result in the excessive clustering of residential conversions, having regard to the residential character of the area
• whether the proposal would provide appropriate internal living conditions for future occupiers of the proposed lower floor flat with regard to outlook, ventilation, daylight and sunlight in the kitchen, and of the top floor flat with regard to floorspace
• whether the proposal would provide appropriate levels of outdoor amenity space for the upper floor flats
• whether the proposal would effect the provision for family accommodation
• whether the proposal would make adequate provision for car and cycle parking

What decided it

The Council's failure to meet the Housing Delivery Test triggered the tilted balance under paragraph 11(d) of the Framework, which meant the limited harms from policy conflicts were outweighed by the benefits of housing delivery in a sustainable location.

The limited harms arising from conflicts with Policy DMD5 (clustering), Policy D6 (outdoor amenity space), and Policy T5 (cycle parking quality) were outweighed by the social, economic and environmental benefits of delivering two additional dwellings in a sustainable location with good public transport access, applying the tilted balance under paragraph 11 of the Framework.
