Main issues, as the Inspector framed them
- whether the appeal site is an appropriate location for the proposed dwellinghouses having regard to the settlement strategy and local and national policies relating to development within rural areas
- whether the proposed development would provide acceptable living conditions for existing and future occupants having regard to the effect on local amenities
What decided it
The realistic fallback position of a permitted conversion to 5 dwellings, which would be a less sustainable development than the proposed 3 dwellings, was accorded significant weight and tipped the balance in favour of allowing the appeal despite conflict with the development plan.
The conflict with the development plan on sustainability grounds was outweighed by the significant weight given to the fallback position (which would deliver more dwellings in a less sustainable manner) and the visual improvements the proposal would bring compared to both the existing situation and the permitted development.
