The failure to demonstrate that the proposed development would not cause adverse effects on the integrity of the Ramsar site, combined with unacceptable harm to character and appearance and the rural landscape, and unresolved drainage concerns, meant the presumption in favour of sustainable development did not apply and the proposal conflicted with the development plan as a whole.

The modest contribution to housing supply and economic and social benefits of construction and occupation were outweighed by unacceptable and harmful effects on character and appearance, rural landscape character, and significant unresolved issues on habitats sites and drainage, with the habitats issue triggering paragraph 11 d) i. of the Framework and disapplying the presumption in favour of sustainable development.
