What decided it

The metal structure at 3.5 metres in height immediately abutting both side boundaries breaches the 2.5-metre height limitation in E.1(e)(ii) of the GPDO applicable to structures within 2 metres of the dwelling boundary, and therefore does not benefit from permitted development rights.
