The out-of-date status of the development plan policies most important for determining the appeal, combined with the presumption in favour of sustainable development under paragraph 11 of the Framework, meant that the modest housing benefits and absence of significant harm outweighed the conflict with Policy PSP40.
The adverse impacts of conflicting with Policy PSP40 did not significantly and demonstrably outweigh the benefits of the proposal in terms of housing supply and site accessibility, such that the presumption in favour of sustainable development applied and permission should be granted.
