What decided it

The submitted details do not satisfy the requirements of conditions 4, 5 and 6, particularly regarding land contamination, site levels and flood evacuation, such that the Inspector cannot be satisfied the development would provide a safe living environment for the occupiers.

The unmet need for gypsy and traveller pitches and the appellants' personal circumstances and Article 8 rights were outweighed by concerns regarding land contamination, flood risk and potential consequences upon personal safety, which the Inspector attached significant weight to.
