- The main issue of the appeal is the effect of the development on the setting of the nearby listed building.
What decided it
For Appeal B the decisive factor was whether the harm to the setting of the listed buildings, to which great weight was given, was outweighed by the benefits of each element of unauthorised work; for Appeals A, C and D the decisive factor was the procedural invalidity of the enforcement notices themselves.
the limited economic, environmental and preservation benefits associated with the unauthorised elements were given very little weight and did not outweigh the less than substantial harm, to which great weight was attributed, caused to the setting of the listed buildings by the dwarf walls, glazed door/opening and slab paving, which were therefore refused, while elements found not to cause harm were permitted
