The adverse effect on the integrity of the Epping Forest SAC, in the absence of a completed legal agreement to secure mitigation, is an overriding consideration that means the development conflicts with statutory provisions, the Framework, and the development plan.

The benefits of housing delivery and efficient use of residential land were outweighed by the adverse effect on the integrity of the SAC, which provided a clear reason for refusal under paragraph 11(d) of the Framework and engaged the habitat protection exception to the presumption in favour of sustainable development.
