Main issues, as the Inspector framed them
- whether the proposed development would comply with national planning policy which seeks to steer new development away from areas at the highest risk of flooding
- the effect of the proposed development on the character and appearance of the surrounding area
What decided it
The proposed development would fail to provide safe access and escape routes during residual flood events as required by paragraph 181 of the Framework, placing future residents at serious risk, and the flood risk policies provide a strong reason for refusal that displaces the presumption in favour of development despite the lack of five-year housing land supply.
The presumption in favour of granting planning permission under paragraph 11 of the Framework does not apply because the flood risk policies protecting areas at risk of flooding provide a strong reason for refusing the development, which outweighs the minor housing and economic benefits.
