Main issues, as the Inspector framed them
- Whether the Council's decision to refuse the certificate of lawfulness is well-founded
- Whether the appeal scheme is inappropriate development in the Green Belt having regard to the National Planning Policy Framework and relevant development plan policies
- The effect of the appeal scheme on the openness of the Green Belt
- If the appeal scheme is inappropriate development, whether the harm by reason of inappropriateness, and any other harm, is clearly outweighed by other considerations so as to amount to the very special circumstances required to justify the appeal scheme
What decided it
The appeal building was located at a significant distance from the dwellinghouse and was not intimately associated with it, therefore the land did not fall within the curtilage of the dwellinghouse and the building did not benefit from permitted development rights, and as inappropriate development in the Green Belt without very special circumstances, the appeal failed.
