What decided it

The proposed extension would have no materially harmful effect on the living conditions of the neighbouring occupiers with respect to outlook, notwithstanding the technical breach of the 3m depth policy limit.

The technical conflict with Policy 72's depth requirement was outweighed by the lack of material harm to neighbouring amenity and the Council's demonstrated flexible application of the policy in similar circumstances.
