What decided it
The engagement of the presumption in favour of sustainable development under paragraph 11d)ii of the Framework, combined with the Council's inability to demonstrate a 5-year housing land supply and the site's classification as Grey Belt meeting all paragraph 155 criteria, meant the material considerations indicated permission should be granted notwithstanding the conflict with the development plan.
The conflict with development plan housing distribution policies (minor weight against) was outweighed by the presumption in favour of sustainable development, the housing land supply shortfall, the use of previously developed land, the sustainable location, and the economic and social benefits of the scheme (all minor weight in favour), such that the adverse impacts would not significantly and demonstrably outweigh the benefits when assessed against Framework policies as a whole.
