The harm to the setting and significance of the Grade II* listed building Burntwood End, which the Inspector found to be less than substantial but of considerable importance and weight, could not be outweighed by the limited public benefits of the proposal, and heritage protection policies provided a strong reason for refusal under paragraph 11(d) of the Framework.
The tilted balance under paragraph 11(d) of the Framework was engaged due to the Council's inability to demonstrate a five-year housing land supply, but the heritage protection policies provided a strong reason for refusal, displacing the presumption in favour of sustainable development; the less than substantial harm to the listed building's setting outweighed the limited public benefits.
