Main issues, as the Inspector framed them
- Whether the enforcement notice was issued outside the time limit under section 171B of the Town and Country Planning Act 1990
- Whether the compliance period of three months is reasonable
What decided it
The residential use of the building could not be demonstrated to have commenced before 1 November 2015, falling short of the ten-year immunity period required under section 171B(3) of the 1990 Act.
The balance between the public interest in securing expeditious compliance with the enforcement notice and the private interests of the appellant in having reasonable time to find alternative accommodation, with six months found to be a more reasonable and proportionate period than three months.
