What decided it
The building was used for residential purposes (additional living space) rather than an incidental use, and therefore did not qualify for permitted development rights; combined with the prior appeal dismissal on Green Belt grounds, the enforcement notice was properly issued and the compliance period was reasonably extended to 10 months to reflect the appellants' circumstances.
The 10-month compliance period balanced the significant financial and personal hardship to the appellants against the public interest in enforcing planning law and protecting the Green Belt from inappropriate development.
