The appellant's evidence was not sufficiently precise and unambiguous to demonstrate on the balance of probability that the 7-bedroom HMO use had subsisted continuously for the required ten-year period, particularly given the absence of documentary evidence for significant periods and the evidence of only five residents on the application date.
