Main issues, as the Inspector framed them
- whether the appeal site is a suitable location of housing with particular regard to the development plan policies for the area
- the effect of the proposed development on the integrity of protected species
What decided it
The Council's inability to demonstrate a five-year housing land supply rendered the relevant development plan policies out of date, engaging the presumption in favour of sustainable development, and the significant housing benefits of the scheme outweighed the policy conflict.
The conflict with development plan policies limiting development in small villages was outweighed by the significant benefits of delivering up to 49 dwellings including 40% affordable housing and associated social and economic benefits, in the context of a substantial shortfall in housing land supply, applying the presumption in favour of sustainable development under paragraph 11(d) of the Framework.
