Main issues, as the Inspector framed them
- whether the proposal would accord with the policies of the development plan relating to affordable and car-free housing
- whether future occupiers of the proposed development would be provided with suitable living conditions, with specific regard to sunlight, outlook and internal layout
What decided it
The failure of the Unilateral Undertaking to include monitoring costs and indexation provisions meant the development could not secure the necessary mitigation to comply with affordable housing and car-free housing policies, and this conflict with the development plan was not outweighed by the limited benefits of the proposal under the paragraph 11.d) balance.
The benefits of providing an additional dwelling in a sustainable location with defined housing need and efficient land use were limited and were outweighed by the conflict with the development plan when assessed against the Framework as a whole under paragraph 11.d).
