The minimum information requirements set out in Article 7 of the DMPO have not been met, which is a fundamental flaw of the proposal and a matter of principal importance given that biodiversity net gain is a statutory requirement.

The moderate benefits of delivering three dwellings on a brownfield site would not significantly and demonstrably outweigh the moderate harm to character and appearance when assessed against the Framework as a whole, but the appeal was dismissed on the separate ground of non-compliance with the DMPO.
