What decided it
The substantial personal circumstances of the appellants, including serious health conditions and disability, combined with the Council's inability to demonstrate a five-year housing land supply and the temporary, personal nature of the permission, meant that the adverse impacts of granting permission did not significantly and demonstrably outweigh the benefits when assessed against the Framework as a whole.
The limited harms to local plan policies and the minor landscape and visual impacts, combined with the temporary and personal nature of the use, were outweighed by the considerable weight given to the appellants' substantial personal circumstances relating to disability, health needs and the requirement for a stable environment, in the context of an out-of-date development plan and the Council's inability to demonstrate a five-year housing land supply.
