Main issues, as the Inspector framed them

  • Whether planning permission should be granted for the installation of two windows (ground (a) s.174 appeal)
  • Whether the windows have harmed the special architectural or historic interest of the listed building
  • Whether the design of the windows is acceptable
  • Whether the windows cause unacceptable overlooking of the neighbouring property

What decided it

The poor design of the windows and the unacceptable overlooking of the neighbour's amenity, both of which could be remedied through obtaining planning permission and listed building consent for acceptably designed windows with obscure glazing, meant the appeals could not succeed without further consent applications.

The relatively minor harm to the heritage asset, which attracts great weight, was not outweighed by any public benefits, and the harm could be easily remedied through obtaining appropriate consents for redesigned windows with obscure glazing.
