Main issues, as the Inspector framed them

  • Whether the material change of use from public house to office use had occurred as a matter of fact by the date the notice was issued (ground (b))
  • Whether the 3 month compliance period falls short of what should reasonably be allowed (ground (g))

What decided it

The balance between timely enforcement and proportionality: whilst ground (b) failed on the factual evidence, ground (g) succeeded because a further 1 month was justified to allow the appellant company to transition to alternative premises without undue disruption, making the original 3 month period unreasonably short.

The Inspector balanced the Council's enforcement objective and the principle of timely planning enforcement against the practical impact on the appellant company's 5 staff and clients, concluding that a 4 month total compliance period was proportionate and remedial rather than punitive.
