What decided it
The inability to secure appropriate mitigation for the effects of the development on the River Avon Special Area of Conservation through either the Council-led nutrient credit scheme or a bespoke mitigation package, which prevented the Inspector from concluding that the proposal would not adversely affect the SAC's integrity.
The benefits of housing supply and efficient use of land in a sustainable location were outweighed by the conflict with Core Policy 50 and the inability to mitigate adverse effects on the River Avon Special Area of Conservation, such that the presumption in favour of sustainable development under paragraph 11(d) of the Framework did not apply.
