Main issues, as the Inspector framed them

  • Whether the material change of use (MCU) provides acceptable living conditions for occupiers with regard to internal and external space, waste and bicycle storage facilities, noise and disturbance, and fire safety
  • The effect of the MCU on living conditions of neighbouring residents with regard to noise and disturbance and waste
  • The effect of the MCU on the supply of family size accommodation within the borough

What decided it

The poor standard of living conditions for occupiers (internal/external space, noise and fire safety) combined with the unacceptable loss of family-sized housing outweighed the limited benefits of the accommodation, leading to dismissal of the ground (a) appeal.

the benefits of flexible and affordable living accommodation and effective use of land were little different to those from the property being occupied as a family dwelling or smaller HMO, and did not outweigh the poor living conditions and the need to protect the supply of family homes
